Short-Term Residence Permit in Turkey
A short-term residence permit is regulated in articles 31 to 33 of the Law on Foreigners and International Protection No. 6458.
In addition, a short-term residence permit is regulated in Articles 28 and 29 of the Regulation on the Implementation of the Law on Foreigners and International Protection.
Who are the Foreigners for whom a Short-Term Residence Permit Can be Issued?
1-Foreigners who will come for the purpose of scientific research;
For this purpose, foreigners who request a residence permit are required to obtain a permit for scientific research from the relevant institutions or organizations that are the subject of scientific research (Ministry of Culture and Tourism, Ministry of Energy, universities, etc.).) to obtain a permit document; in case it is not subject to permission, it is requested to submit a statement related to the research topic.
2-Foreigners who have immovable property in Turkey;
If foreigners who have immovable property request a residence permit, the immovable property must be residential and used for this purpose. In addition, if family members have a shared or joint ownership right over the housing, family members can also apply for a residence permit in this context.
3-Foreigners who will establish a commercial connection or business;
If foreigners who will establish a commercial connection or business request a residence permit for more than three months, an invitation letter or similar documents of the persons or companies they will contact may be requested from the foreigner.
4-Foreigners who will participate in the in-service training program;
Residence permits issued for this purpose are issued during the program based on the information and documents about the content, duration, location of the training offered by the institution or organization that will provide in-service training.
5-Foreigners who will come for educational or similar purposes within the framework of agreements or student exchange programs to which the Republic of Turkey is a party;
For this purpose, foreigners requesting a residence permit are requested to submit the information and document to be obtained from the relevant institution.
The duration of the residence permit cannot exceed the duration of the education or similar purpose.
Student exchange programs (Erasmus, Mevlana, Farabi, etc.) students who come within the scope of; those who make a request to become a general health insurer within three months from the date of their first registration are not required to have health insurance separately. However, those who have lost the right to be a general health insurer by not applying within three months from the date of registration are asked to take out private health insurance.
6-Foreigners who will stay for tourism purposes;
For this purpose, the declaration of foreigners requesting a residence permit regarding their travel plans (such as where, when and for how long to stay in the country) is evaluated. If deemed necessary, he may be asked to provide information or documents.
7-Foreigners who will receive treatment provided that they do not carry one of the diseases that are considered a threat to public health;
For this purpose, admission of foreigners who come to Turkey to public or private hospitals is sought. Of these, the health insurance requirement is not required from those who document that they have paid all treatment costs.
Residence permits are issued in accordance with the treatment periods.
During the treatment period, foreigners whose expenses related to housing, food or health are covered by the relevant public institutions and organizations are not required to have valid health insurance with the determination of financial means.
If necessary, information or documents may be requested from the relevant hospital or public institution and organization regarding the treatment of a foreigner.
Within the scope of the current Health Cooperation agreements, the residence permit procedures of the escorts of foreigners who come to our country for treatment (if there is no separate provision regarding the escorts in the agreement) are carried out in accordance with the general provisions.
In addition, according to October 14 of the Basic Law on Health Services No. 3359, the valid health insurance requirement is not required for residence permit applications from the companions of foreigners who do not exceed a maximum of two people arriving in our country.
8- Foreigners who must stay in Turkey depending on the requests or decisions of the judicial or administrative authorities;
The duration of the residence permit to be issued for this purpose is regulated by taking into account the period specified in the decision or request.
9-Foreigners who will be transferred to a short-term residence permit in case of loss of family residence permit conditions;
10-Foreigners who will participate in Turkish learning courses;
For this purpose, the institution requesting a residence permit and authorized to provide a Turkish course (must have permission from the Ministry of National Education.) can be given to the registered foreigner no more than twice.
If the course duration is less than one year, the residence permit duration cannot exceed the course duration. The institution providing the course is obliged to inform the provincial directorate of the start and attendance status of the foreigner who has registered for the purpose of studying Turkish.
11-Foreigners who will participate in education, research, internship and courses in Turkey through public institutions;
The duration of the residence permit issued for this purpose cannot exceed one year. Foreigners whose expenses related to housing, food or health are covered by the relevant public institutions are not required to have valid health insurance with the determination of financial means. Information and documents may be requested from the institutions.
12- Foreigners who have completed their higher education in Turkey and who have applied within six months from the date of graduation;
For this purpose, foreigners who request a residence permit may be granted a one-time residence permit for a maximum of one year if they apply within six months from the date of graduation.
13-Those who do not work in Turkey, but will invest in the scope and amount to be specified by the Council of Ministers, as well as their foreign spouse, his and his spouse’s immature or dependent foreign child;
For this purpose, a residence permit may be issued to foreigners who request a residence permit for a maximum of five years.
With this amendment of the International Labor Force Law No. 6735 and the Law No. 6458, it is aimed to encourage qualified foreigners who will contribute to the national economy and to facilitate residence permit procedures for foreigners.
14-Foreigners who are citizens of the Turkish Republic of Northern Cyprus,
For this purpose, a residence permit can be issued to foreigners who request a residence permit for a maximum of five years.
How Many Years Can a Short-Term Residence Permit Be Issued For?
Short-term residence permit, above 13. and 14. it can be arranged for a maximum of two annual periods each time, excluding foreigners who are in the queue.
What are the Conditions for a Short-Term Residence Permit?
In order for a short-term residence permit to be issued, foreigners must meet the conditions set out in Article 32 of the Law.
– To submit supporting information and documents related to the purpose of staying in Turkey,
– Not to fall within the scope of Article 7 of the said Law,
– To have housing conditions in accordance with general health and safety standards,
– To submit, if requested, the document showing the judicial registration record issued by the competent authorities of the country in which he is a citizen or legally residing,
– To provide the address information where he will stay in Turkey.
What are the reasons for the Refusal, Cancellation or Non-Extension of a Short-Term Residence Permit?
– Non-fulfillment or disappearance of one or more of the conditions required for a short-term residence permit,
– Determination that the residence permit is used outside the purpose of issuance,
– The existence of a valid decision of deportation or prohibition of entry into the country,
– Deduction of a violation in terms of the duration of stay abroad,
in their case, a short-term residence permit is not granted, if granted, it is canceled, those whose term expires are not extended.
