Family Residence Permit in Turkey

Family residence permit is regulated in articles 34 to 37 of the Law No. 6458 on Foreigners and International Protection. In addition, a family residence permit is regulated in articles 30 to 34 of the Regulation on the Implementation of the Law on Foreigners and International Protection.

Who are the Foreigners for whom a Family Residence Permit Can be Issued?
Turkish citizens, those who are covered by Article 28 of the Law No. 5901 or foreigners who have one of the residence permits, refugees and holders of secondary protection status;

a) To the foreign spouse,
b) His or her spouse’s non-mature foreign child,
c) His or her spouse’s dependent alien child,
a family residence permit can be arranged.

If the foreigner requesting a family residence permit has more than one spouse, a family residence permit may be issued to only one of the spouses. However, a family residence permit can be issued to all children of a foreigner.

Children’s family residence permit requests must have the consent of the mother or father who have joint custody, if any, outside our country.

The family residence permit provides the right to study in primary and secondary educational institutions up to the age of eighteen without obtaining a student residence permit.
For How Many Years Can a Family Residence Permit Be Issued?

-Family residence permit can be issued in a way that does not exceed three years each time.
-The duration of the family residence permit may in no way exceed the duration of the sponsor’s residence permit.

What are the Conditions of the Family Residence Permit?

In order for the family residence permit to be issued, foreigners must meet the conditions set out in Article 35 of the Law.

– To meet the conditions required in the promoter,
(Sponsor’s valid health insurance that covers the whole family per capita monthly income of no less than one-third of the minimum wage have family that has committed a crime against the order in the last five years the criminal records with documentation, less than a year to reside in Turkey and the address to be registered in the registration system)
– To meet the conditions required for those who request a family residence permit to stay with the promoter,
(Submitting supporting information and documents related to the purpose of staying in our country, revealing that they live or intend to live with the specified persons, that the spouses have reached the age of eighteen, that they do not fall within the scope of Article 7 of the said Law, that the marriage was not made for the purpose of obtaining a family residence permit)

What are the reasons for the Refusal, Cancellation or Non-Extension of the Family Residence Permit?

– Non-fulfillment or disappearance of the conditions required for a family residence permit,
– Determination that the family residence permit has been used outside the purpose of its issuance,
– The existence of a valid decision of deportation or prohibition of entry into the country,
in their case, a family residence permit is not granted, if granted, it is canceled, those whose term expires are not extended.
