OUR EXPLANATIONS
1-) It has been decided to arrest our client at the hearing of the public lawsuit filed against him on the date of … / … / … with the file numbered …/ … E of your court about our client.
2-) Our client; As he owns a fixed place of residence, the house in which he lives also belongs to him. The client has been practicing his farming profession since childhood, and before his arrest, he carried out the October process in his field. In addition to the fact that there is no one who can take care of his field other than himself, the harvest time of the crops has come, the products that have not been harvested will perish, and the client and his family will be in an extremely difficult economic situation. In addition, he has not been involved in any crime so far and does not have any negative records in his criminal record. It is obvious that there is no suspicion of escape.
3-) Although our client, who is a suspect in the related crime alone, does not have any other accomplice who is a suspect; all the evidence related to the crime has been collected and kept. For this reason, there is no suspicion of our client blacking out the evidence.
4-) The witnesses also gave their statements to both the law enforcement and the Public Prosecutor’s Office during the preparatory investigation, and there were no question marks about the investigation stage.
5-) Considering the nature and elements of the crime and in any case, according to the contents of the file, there is no reason to decide on the continuation of the state of detention imposed on our client with a fixed residence, who has no criminal record.
CONCLUSION AND REQUEST : … We respectfully request bilvekale on behalf of our client to decide on the release of our client with the acceptance of our objection to the Assize Court’s decision on the continuation of his daily detention. …/…/…
